Whether or not you’re covered by FMCSA (Federal Motor Carrier Safety Administration) safety standards depends on several factors based on your vehicle type, area of operation, and cargo. FMCSA regulation typically applies to CMVs in interstate commerce that are at least one of the following:

      • Vehicle Weight: If you own a vehicle with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR) of 10001 lbs or greater.
      • Passenger Count: You take over eight (including the driver) passengers to be paid for, or over 15 passengers to be unpaid.
      • Hazardous Materials: Your vehicle is used to transport materials classified as hazardous by the Department of Transportation (DOT) that require a notice.

You will be required to follow the FMCSA’s safety regulations, such as hours of service reporting, drivers, vehicle maintenance, and reporting if your operation is one of these categories. The FMCSA’s regulation is meant to maintain road safety and reduce the risks posed by long-haul commercial transport.
