The Federal Motor Carrier Safety Administration (FMCSA) allows personal conveyance for the personal use of a commercial motor vehicle by a driver who is OFF-Duty. This is described as US truck regulation in its current form to ensure that drivers would not be penalized for taking care of things like their own food or a sick child.

A driver is allowed to drive the truck for personal conveyance – including to a safe parking area, for meals, or to a hotel, all under the condition that he or she is off duty and not driving during a required rest period. The key is that personal conveyance driving is not on-duty or driving to reach the maximum driving time.

Per FMCSA rules, personal conveyance must not add to the driver’s compensation and must be recorded. Fleet managers must make sure their ELD or other trackers monitor and record these periods to avoid violations.
