While most commercial drivers must use an Electronic Logging Device (ELD) to comply with the FMCSA’s Hours of Service (HOS) regulations, certain drivers and vehicles qualify for exemptions. These exemptions ensure that ELD requirements are practical and reasonable for all operations.
Categories Exempt from Using an ELD:
- Short-Haul Drivers: Drivers operating under the short-haul exemption (within a 150-air-mile radius) and who complete their work within a 14-hour shift are not required to use an ELD, as they do not need to maintain Records of Duty Status (RODS).
- Pre-2000 Vehicles: Drivers operating vehicles manufactured before 2000 are exempt because these vehicles often lack the electronic control modules (ECMs) needed for ELD connectivity.
- Driveaway-Towaway Operations: Drivers involved in driveaway-towaway operations, where the vehicle being transported is the commodity, or when the vehicle being driven is part of the shipment, are exempt.
- Drivers Operating Less than 8 Days in 30 Days: If a driver maintains RODS for 8 days or fewer within any 30 days, they are not required to use an ELD.
