The Break Requirement states that a motor carrier shall not allow or require a driver to drive a property-carrying commercial motor vehicle beyond 8 hours without at least a 30-minute break. This means that if the driver has been operating a property-carrying CMV for 8 consecutive hours from the previous time off duty, the driver is required to take a break and may do so off-duty, in the sleeper berth, or on-duty, not driving.
